南韓憲法法院於2019年裁定刑法墮胎罪規定違憲，禁止墮胎的法律以保護胎兒生命為目的，並非最小侵害手段，侵害了女性的自主決定權與尊嚴。判決要求國會在2020年底前完成修法，然而，直至條文失效的期限沒有任何修法法案通過，墮胎規範陷入混沌不明的狀態。憲法上承認墮胎權、墮胎去刑罰之後，生育權與生育正義是否真的獲得了保障？
本場演講將回顧2019年的憲法法庭判決，並且探討在憲法化墮胎權之後，韓國的生育正義的政策、社會實踐，以及面臨的困境。特別邀請首爾大學法學院Hyunah Yang（양현아, 梁鉉娥）榮譽教授，教授長期致力於家族法、性別平等、殖民主義、慰安婦與轉型正義、女性主義法學與生育權議題，並曾親身參與2012年墮胎權的憲法法庭案件，不過當時未能推翻墮胎禁令。臺灣近年展開墮胎罪的修法討論，南韓的經驗與困境值得借鏡，由Yang教授探討南韓的實踐，尤具意義。
In 2019, the Constitutional Court of South Korea ruled the Criminal Act criminalizing abortion unconstitutional. The Court held that the ban, justified in the legislative purpose of protecting fetal life, was not the least restrictive means. It violated women’s autonomy and dignity. The Court ordered the National Assembly to amend the law by the end of 2020. However, no legislative reform was passed by the deadline, leaving abortion regulation in a state of legal uncertainty. After the constitutional recognition of abortion rights and the decriminalization of abortion, have reproductive rights and reproductive justice truly been secured?
This lecture will review the 2019 Constitutional Court decision and examine Korea’s policies, social practices, and continuing challenges in the wake of the constitutionalization of abortion rights. We are honored to host Professor Hyunah Yang (양현아, 梁鉉娥), Honorary Professor at Seoul National University School of Law. Professor Yang has long devoted her research to family law, gender equality, colonialism, comfort women and transitional justice, feminist jurisprudence, and reproductive rights, and she directly participated in the 2012 Constitutional Court case, but it could not strike down the abortion ban. As Taiwan embarks on discussions about reforming abortion laws, South Korea’s experience and struggles provide important lessons. Professor Yang’s insights will be especially significant in this context.
